Now, after 10 months, WorkSafe has dropped the charges in exchange for Fortescue’s agreement to enter into an enforceable undertaking.

The enforceable undertaking does not involve a finding or admission of guilt.

As part of the agreement, Fortescue will take action in areas such as education and performance of contract workers, as well as promoting a more positive culture among executives.

This is the first enforceable undertaking under the state’s new work health and safety legislation, and Fortescue has committed to investing over $1.4 million in this initiative.

WorkSafe will closely monitor the progress of the undertaking, and further action will be taken if the commitments are not delivered.
